Authorīs Agreement :
If you want to sell models at our sites,
we will do our best to make it possible.
We have however made a few unpleasant experiences
with people trying to sell somebody elseīs models
to us and need to safeguard a bit against
unpleasantries.
Here is a simple agreement:
Agreement between an author ("author") of 3d content/models
("models(s)") and 21st Century Solutions Ltd./3DSpecial ("21st").
1. 21st declares that it will do everything in itīs power to plausibly
promote, sell and successfully market the authorīs model(s) and further
the authorīs business interests but is not to be held responsible if sales
do not reach authorīs expectations.
It is 21st`s policy that author should determine the worthiness
and pricing of the content 21st sells for him to his own deliberation -
though it may be an important factor for the success of model sales,
21st can only advise in this respect.
Of all sales 21st makes of his content, author is paid 60 percent
before taxes (see 5).
2. Author and 21st will do their best to help each other in marketing,
both parties agree on keeping each otherīs business secrets and not
disclosing any parts of their agreements and conversations to third
parties under any circumstances.
3. Copyrights stay with author and are not sold but only leased to 21st
for the period of the agreement for the purposes of marketing,
(if no special agreement overrides this paragraph, or the models are especially
made for 21st). The agreement is also non-exclusive; so author can make similar
non-exclusive agreements with third parties (other sellers) and explicitly also sell
the models(s) himself via his own means as long as the copyrights
are not sold along with them but stay in authorīs possession.
4. By uploading/sending/leaseing model(s) of his own make and/or copyright
to be sold (under commission) for him by 21st online or by any other means,
author thereby declares that the model(s) and all the rights to them belong
to author only and are of authorīs own copyright, that no third party rights are
involved, and that these are to be marketed for author by 21st in whichever
way 21st deems approriate (as long as these means do not infringe on authorīs
rights) -see 3 -, for a period of five years (a different period can be agreed
upon), which is automatically prolonged for the same period if no other
agreement takes this agreementīs place.
5. Payments will normally be made when at least 100 dollars are accrued,
otherwise whenever the author plausibly desires so - 21st pays out
by check, bank transfer, Paypal and Western Union to authorīs desire.
It should be mentioned that Western Union is a fast but
also expensive method and unwise to use below 250 dollars US.
Taxes will be deducted from authorīs payments once yearly
only if author fails to supply 21st with plausible invoices (which can
lead to 21st having to pay excessive taxes).
